This appeal relates to a complaint made to Engineering New Zealand, by the owners of a property, against a Chartered Professional Engineer engaged by a design build firm,  in relation to the structural design of a new habitable build.

This appeal was filed by the owners, on the grounds of r 42E (a) (iii) and r 42 (b) (i), engineering activities were not carried out in a careful and competent manner and misrepresentation of competence.   

The panel found the Chartered Professional Engineer had not breached his personal obligation under r 42E (a) (iii); and the question of misrepresentation of competence fell outside the scope of the original complain, and the scope of this appeal. 

The appeal was dismissed.
