A complainant appealed a decision of a Chair of Investigating Committees, acting as Adjudicator, to dismiss complaints against a Chartered Professional Engineer. Having found that none of the grounds of appeal are made out, the decision of the Panel is to exercise its power in s 37(5)(a) of the Act to confirm the parts of the decision of the CIC that have been appealed and dismiss the Appellant’s appeal.

A Chartered Professional Engineer appealed decisions of the Disciplinary Committee of Engineering New Zealand. The Appeal had 13 grounds of appeal. The Appeal Panel found that 12 of the grounds for appeal were not proven. The Appeal Panel upheld the ground of appeal that the Chartered Professional Engineer is not identified in the published Disciplinary Committee decision.

The Appellant has appealed a decision of the Competency Assessment Board to amend the Appellant’s practice area description and require the Appellant to apply for continued registration within 2 years. The Appeal Panel found that none of the grounds for appeal were proven. The Appeal Panel dismissed the appeal and the CAB’s decision on the Appellant’s CPEng continued registration is upheld.

The appeal is of a decision by the Investigating Committee acting as the Adjudicator for the Registration Authority to dismiss a complaint on the basis of r57(a) by a chartered professional engineer, about another CPEng, rather than to refer it to an Investigating Committee. The Appeal Panel has determined that, in all of the circumstances, the complaint should be dismissed on the basis of rule 57(ba) of the Rules. That is, the alleged misconduct is insufficiently grave to warrant further investigation. Therefore, the Appeal Panel reverses the decision of the CIC to dismiss the complaint on the basis of rule 57(a) and instead dismisses it on the basis of rule 57(ba).

An Appellant has appealed a decision made by the Chair of the Investigating Committee (IC)of the Registration Authority not to refer a complaint against a Chartered Professional Engineer, to an Investigating Committee. The Appeal Panel found that there is sufficient evidence that warrants further investigation of the complaint by the RA. The appeal was upheld and the RA’s decision not to refer the complaint against the Appellant to an IC is overturned. The RA is therefore required to refer the complaint to an IC.

This decision relates to an application under s 36 of the Chartered Professional Engineers Act 2002 for an order preventing deregistration until the associated appeal against a decision to decline continued registration as a CPEng is heard. The panel granted the application, ordering that the decision under appeal be stayed until determination of the appeal.
