“An engineer appealed one element of a decision of a Chair of Investigating Committees, acting as Adjudicator, to refer a complaint about him to an investigating committee. The complaint had been filed on behalf of a local authority and the element being appealed concerned unconsented building work, in particular failing to advise the client of the need to obtain consent before proceeding with building works. The appeal panel found that none of the grounds filed provided a basis to overturn the decision being appealed. The panel dismissed the appeal and accordingly ruled that the decision of the Adjudicator to refer the matter to an investigating committee stands.”
