Appeal Description

This appeal relates to a complaint made to Engineering New Zealand in relation to a report prepared by a Chartered Professional Engineer for an underpinning contractor involved  in a commercial dispute with the Appellant.

Appeal Finding

This appeal was declined. The appeal panel found that the Respondent met the essential requirements of his obligations as a Chartered Professional Engineer, was not practising outside his area of competence and, while he could have covered the reasons and calculations behind his professional opinion in a clearer manner,  gave unbiased and independent advice to his client which was not detrimental to the outcome of the  dispute.
